Terms of Service

2.1 What we provide

Hotel Lobby AI lets you upload two portrait photos (or one photo of two people), choose a stage template, and generate a short AI rap duo video with AI-generated sound, 5, 10 or 15 seconds long, in 16:9 or 9:16 format, at 480p (Draft), 720p (Standard) or 1080p (Pro). Your photos are composited in your browser into a single source frame, which is then animated by an AI video model. The Service is a digital software-as-a-service (SaaS) product delivered over the Internet.

2.2 Nature of the Service

The Service is an intangible digital product. Credits and plan benefits are delivered to your account immediately after payment is confirmed. Because of this immediate delivery, refunds are subject to the limits in Section 7 and our Refund Policy.

2.3 Third-party AI model dependency

Video generation is performed by third-party AI model providers, currently fal.ai (ByteDance Seedance 2.0 video models). Performance, output quality and availability may be affected by those providers. We will notify users of significant outages.

2.4 Music and original works

Generated videos are newly created performances. The Service does not provide, license or include the original "Hotel Lobby" song, its music video, or any other third-party music or footage. You are solely responsible for any audio or media you add to a video after downloading it.

3.1 Account creation

You need an account with accurate, complete information to use the Service. You are responsible for keeping your credentials confidential and for all activity under your account.

3.2 Account security

• Report any unauthorized use immediately to support@hotellobbyaidesign.com.
• Do not share your login credentials with any third party.
• Keep the email address on your account active and up to date.

3.3 Organization accounts

If you register on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.

5.1 Subscription auto-renewal authorization

By subscribing to a paid plan, you expressly authorize [YOUR LEGAL NAME OR COMPANY NAME] and our payment processor to charge the applicable subscription fee to your payment method on a recurring monthly basis until you cancel under Section 6. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date. We will notify you by email at least 14 days before any price change takes effect for your subscription.

5.2 Credit pack purchase authorization

Each credit pack purchase is a one-time transaction. By completing the purchase you authorize a single charge for the amount shown at checkout. We do not offer automatic top-ups.

5.3 Payment processor

Payments are processed by Waffo Pancake, which acts as our merchant of record and PCI-DSS compliant payment processor. Your card details are handled exclusively by Waffo Pancake and are never stored on our servers. The charge may appear on your card statement under the name of Waffo Pancake or Hotel Lobby AI.

5.4 Taxes

Unless stated otherwise, prices are shown in US dollars and exclude applicable taxes (such as VAT, GST or sales tax). Where required by law, taxes are calculated and collected at checkout.

7.1 Subscription refunds

• First-time subscriber 7-day guarantee: a full refund of your first subscription payment if requested within 7 days and you have used no more than 20% of that month’s plan credits.
• Duplicate charges or a verified service outage caused by us lasting more than 72 hours: refund or credit compensation.

7.2 Credit pack refunds

• Unused credit packs: a full refund if requested within 7 days of purchase and none of the purchased credits have been used.
• Credits already consumed are non-refundable.
• Failed generations: if a generation is recorded as failed, its credits are automatically returned to your balance.

7.3 Plan credit rollover

Credits included in a subscription plan are added to your balance at the start of each billing period and roll over: they do not expire while your account remains open.

7.4 Credits after cancellation

Separately purchased credits are unaffected by your subscription status. After you cancel a subscription, all credits already in your balance (including rolled-over plan credits) remain usable while your account is open. Credit packs never expire.

7.5 Credit consumption order

All credits — sign-up, plan and pack credits — are held in a single balance and are consumed from that balance; there is no separate consumption order.

7.6 Statutory rights

Where applicable law grants you a right of withdrawal (for example the 14-day right for consumers in the EU, UK or Australia), that right is preserved for first-time purchases. Because digital content is delivered immediately, the right ends once you start using the purchased credits, where the law permits.

9.1 Ownership of outputs

Subject to these Terms, you own the videos generated from your inputs ("Outputs"). You may use Outputs for any lawful purpose permitted under Section 10. Outputs may be similar to content generated for other users, and we do not guarantee that Outputs are unique or eligible for copyright protection.

9.2 License to your inputs

By uploading photos or other content ("Inputs"), you grant [YOUR LEGAL NAME OR COMPANY NAME] a limited, non-exclusive license to process them solely to provide the Service to you. We do not use your Inputs or Outputs to train AI models, and we do not publish them as examples, without your explicit consent.

9.3 Third-party AI models

Outputs are produced by third-party AI models (fal.ai (ByteDance Seedance 2.0 video models)). We do not guarantee a particular appearance, likeness, motion quality, lip sync or delivery time, and we are not responsible for content generated by third-party models.

9.4 Accuracy of AI output

AI-generated content may contain errors or artifacts. You are responsible for reviewing every video before sharing it publicly.

10.1 Photos and consent

You may only upload photos you have the right to use, and you must have the permission of every person shown to use their likeness in a generated video. Do not upload photos of minors unless you are their parent or legal guardian or have that person’s consent.

10.2 Prohibited uses

You agree not to use the Service to:

• Generate illegal, defamatory, harassing, hateful or fraudulent content.
• Create, distribute or assist in producing deepfakes — AI-synthesized video, audio or images that impersonate a real person (including celebrities, public figures or politicians) or that are intended to mislead viewers about their origin or authenticity.
• Generate sexual or sexually suggestive content, or any content that sexualizes minors or violates child-protection laws.
• Bully, intimidate, humiliate or harass any person, or use someone’s image without consent.
• Infringe any third party’s intellectual property, publicity or privacy rights.
• Create malware, phishing content or cyber-attack tools, or bypass or interfere with the Service’s security features or usage limits.
• Resell or sublicense access to the Service without our prior written approval.
• Violate any applicable law, regulation or card network rule.

10.3 AI-specific restrictions

• Do not use the Service’s inputs, outputs or derived data to train, fine-tune, benchmark, distill or otherwise develop any AI or machine-learning model that competes with the Service.
• Do not systematically scrape, extract or harvest outputs at scale for purposes other than your own authorized use.
• Do not present AI-generated videos as genuine recordings of real events or people.

12.1 Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR ACCURACY OF AI OUTPUT.

12.2 AI-generated content disclaimer

Outputs are synthetic entertainment content. They may be inaccurate or contain visual artifacts and must not be relied on as a real depiction of any person or event.

12.3 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, [YOUR LEGAL NAME OR COMPANY NAME] WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
